University Park Governing Documents
University Park is a covenant protected community governed by a volunteer Board of Directors elected by the homeowners. The Board is responsible for enforcing and administering the Association’s Governing Documents.
These documents are legally binding and establish how the community operates, the standards that apply to properties, and the rights and responsibilities of owners.
If there is ever a conflict between documents, the higher level document in the hierarchy will control, provided it complies with current Colorado law.

Declaration of Covenants, Conditions, Restrictions and Easements (CC&Rs)
The Declaration, commonly referred to as the CC&Rs, is the primary governing document for the community. It is recorded with El Paso County and runs with the land, meaning it is legally binding on all current and future property owners.
The Declaration establishes property use restrictions, maintenance responsibilities, assessment authority, architectural requirements, and the overall structure of the Association.
The University Park Declaration is recorded under Reception Number 098005438, dated January 15, 1998, and is on file with the El Paso County Clerk and Recorder.
Recorded Plats and Maps
Recorded plats define property boundaries, lot configurations, easements, common areas, and other physical characteristics of the community. These documents are recorded with the county and may impact fencing, improvements, drainage, and maintenance responsibilities.
Articles of Incorporation
The Articles of Incorporation establish the Association as a nonprofit corporation under Colorado law. This document creates the legal entity of the Association.
Bylaws
The Bylaws govern how the Association operates internally. They outline procedures for Board elections, meeting requirements, voting processes, officer roles, and general governance structure.
Rules and Regulations
Rules and Regulations are adopted by the Board of Directors to clarify or supplement the Declaration and Bylaws. These rules address operational and community matters and must not conflict with higher level governing documents.
Policies, Procedures, and Resolutions
The Board may adopt formal policies or resolutions to address specific topics such as collections, enforcement procedures, architectural review processes, or other administrative matters.
Design Guidelines and Community Standards
Design Guidelines provide architectural and exterior modification standards. These guidelines are used by the Architectural Control Committee when reviewing improvement requests to ensure consistency and preserve the overall appearance of the community.
